Former New York Giants star receiver had applied for work release, but is not getting out of prison just yet.

Burress' request came about two months into the two-year sentence he received for carrying an unlicensed gun that went off and wounded him at a Manhattan nightclub.

Under New York State law, inmates convicted of nonviolent offenses can apply for work furloughs within two years of their release dates. Burress pleaded guilty in August to a form of attempted criminal possession of a weapon that allows him to be eligible for work release.

According to state corrections officials, inmates on work release generally get to spend several days and nights each week out of prison working and reconnecting with their families; the exact arrangements vary for each inmate. Some are allowed out full-time for the last few months of their sentence.

"It's too early," said Manhattan Chief Assistant District Attorney Mark Dwyer. He went on to say that granting a quick furlough would send "a very bad message."

After being drafted eighth overall in the 2000 NFL Draft, Burress went on to play five years with the Pittsburgh Steelers, amassing 261 receptions for 4,164 yards, 22 touchdowns over a span of 71 games.

On March 17 2005, he signed a six-year, $25 million contract with the Giants. In his time in New York he caught 244 balls for 3,681 yards and 33 touchdowns. With his legal trouble looming, Burress was released by the Giants on April 3, 2009.

He has a month to appeal the decision. He also can reapply for work release in July.
